Agreement and Disclosure





Disclosure to Report Subjects

1. The Fair Credit Reporting Act allows me to obtain a disclosure from every credit reporting agency of the nature and substance of all information in my file at the time of the request. Full disclosure of information in your file at Experian must be obtained directly from Experian by calling 888-397-3742 or logging on to www.experian.com/consumer The credit information that I am requesting from Rent Perfect, Inc. is not intended to constitute the disclosure of Experian information required by the Fair Credit Reporting Act or similar state laws.

2. I am entitled to receive a disclosure directly from the consumer reporting agency free of charge under the following circumstances:

  • a. I have been denied credit, insurance or employment within the past sixty (60) days as a result of my credit report
  • b. I certify in writing that I am unemployed and intend to apply for employment in the 60-day period beginning on the date on which I made the certification
  • c. I am a recipient of public welfare assistance
  • d. I have reason to believe that my file at the agency contains inaccurate information due to fraud
  • e. Annually at www.annualcreditreport.com

Otherwise, the consumer reporting agency may impose a reasonable charge for the disclosure.

3. The Fair Credit Reporting Act permits me to dispute inaccurate or incomplete information in my credit file. I understand that accurate information cannot be changed.

4. I do not have to purchase my credit report or other information from Rent Perfect, Inc. to dispute inaccurate or incomplete information in my Experian file or to receive a copy of my Experian consumer credit report.

5. Experian's National Consumer Assistance Center provides a proprietary consumer disclosure that is different from the credit/criminal history provided by Rent Perfect, Inc.. I understand that the disclosure report must be obtained directly from Experian. Consumers residing in the States of Colorado, Massachusetts, Maryland, New Jersey, and Vermont may receive a free copy of their consumer credit report once per year and residents of the State of Georgia may receive two copies per year.

6. Fraud Alerts are available to any eligible consumers - free of charge - from a national consumer reporting agency.

VANTAGESCORE NOTICE

Prior to the disclosure of any VantageScore by Reseller hereunder, Reseller shall provide notice to the applicable Report Subject and Customer substantially similar to the following:

The Report and Score Services utilize the VantageScore© credit score. The VantageScore credit score may or may not be used by Report Subject's lenders, and is not an endorsement or guarantee of Report Subject's credit worthiness as seen by lenders.

Please be aware that there are many scoring models used in the marketplace. Each scoring model may have its own set of factors and scale. The information and credit scoring may be different than that used by a lender. The VantageScore credit score may not be identical in every respect to any other credit score produced by another company or used by Report Subject's lender.

Report Subject's VantageScore credit score is calculated using Report Subject's actual data from Report Subject's credit file on the day that the Report and Score Services are requested by Investigative Screening Company. Keep in mind, however, that other factors, such as length of employment and annual salary, are often taken into consideration by lenders when making decisions about Report Subject. How each lender weighs its chosen factors may vary, but the exact formula used to calculate Report Subject's score is proprietary.

Also note that each consumer reporting agency has its own set of data, resulting in a separate VantageScore credit score for each of Report Subject's credit files.

You agree to request VantageScore credit scores only for your use alone for the purposes certified to Investigative Screening Company and for no other purpose or use. All VantageScore credit scores provided hereunder will be held in strict confidence and may never be sold, licensed, copied, reused, disclosed, reproduced, revealed or made accessible, in whole or in part, to any person except as required by law or as otherwise set forth in your agreement with Investigative Screening Company.

In relationship to my requesting, authorizing and instructing Rent Perfect, Inc. to obtain and share my criminal, credit and other background information, as set forth above, I specifically waive any rights to join any claim(s) with claims of others in any form of class action or any similar procedure regarding any claim, dispute or controversy linked to, arising out of, or in any way related to, or associated with: obtaining my personal credit, criminal or other history or sharing it with my prospective landlord/property manager or their agents; any landlord/property manager denying me residency; missing any pertinent historical information in the investigation results; having inaccurate or outdated information in the investigation results. I specifically agree that for any claim, dispute or controversy linked to, arising out of, or in any way related to, or associated with any scenario or type of claim as set forth in paragraphs above, that I waive any and all rights to a jury trial or to a trial by a judge. I agree that any claim, dispute, or controversy of any kind whatsoever linked to, related to, arising out of or regarding any scenario or type of action as set forth above shall be brought through arbitration pursuant to the American Arbitration Association rules. Additionally, I specifically waive any and all rights to appeal of the arbiter's or arbiters' decision in arbitration. I further specifically agree that Mesa, Arizona, is the exclusive venue and jurisdiction for arbitration. Lastly, notwithstanding any rules to the contrary, I agree that each party shall be responsible for their own attorney fees and costs for any claims.

Additional Disclosure to Report Subjects

NOTICE TO CALIFORNIA CONSUMERS:

A Consumer Report provided by Investigative Screening and Consulting, Inc, dba Rent Perfect, is made pursuant to requirements set forth the California Investigative Consumer Reporting Agencies Act, California Civil Code §1786, et seq. ("ICRAA") when the investigation is requested/ordered and performed for a housing provider. When an investigation is not ordered/requested by a housing provider, the insurance industry or by an employer or prospective employer, then the California Investigative Consumer Reporting Agencies Act, California Civil Code §1786, et seq. ("ICRAA") and the Fair Credit Reporting Act, are not applicable regarding that investigation and investigative results. Rent Perfect does not perform investigations or provide consumer reports for or in relationship to the insurance industry or for employment purposes.

In regard to Rent Perfect providing investigations and consumer reports for and to housing providers, all housing providers shall certify to Rent Perfect that the consumer has provided the housing provider written authorized for the housing provider to perform a Consumer Investigation performed and receive and a Consumer Report regarding the consumer's character, general reputation, personal characteristics, criminal history and mode of living. For each Consumer Report Rent Perfect summits to a housing provider Rent Perfect shall identify and disclose to all parties its name, address, and telephone number.

If an Investigative Consumer Report is sought in connection with the hiring of a dwelling unit (a housing provider seeking a consumer investigation and consumer report), as defined in California Civil Code §1940, subdivision (c), Rent Perfect shall require the housing provider to agree that it will, not later than three days after the date on which the Investigative Consumer Report was first requested, notify the consumer in writing that an Investigative Consumer Report will be made regarding the consumer's character, general reputation, personal characteristics, criminal history and mode of living. The notification shall also include the name and address of the investigative consumer reporting agency that will prepare the Investigative Consumer Report and a summary of the provisions of California Civil Code §1786.22.

Rent Perfect shall require the housing provider to certify that it will provide a copy of the Investigative Consumer Report to the subject of the investigation, as provided in California Civil Code §1786.16, subdivision (b). III.

Rent Perfect shall comply, and shall ensure that each housing provider complies, with all technical requirements applicable to transactions involving the request for, and receipt of, Investigative Consumer Reports under ICRAA.

Rent Perfect will process consumer disputes in accordance with General Reseller Policy and the law.

In response to a consumer's request pursuant to California Civil Code §1786.11, Rent Perfect shall have procedures in place to verify the identity of the consumer making the request and shall maintain all records in connection with such request for a minimum of five (5) years.
